Adding an AI chatbot to WhatsApp is one of the fastest ways to improve customer service. But every conversation carries personal data: names, phone numbers, appointments and sometimes sensitive information. If your business is in Europe or serves European customers, the GDPR applies, and choosing the right provider is part of complying.
This guide helps you do it with judgement. It doesn’t replace your legal adviser, but it gives you the right questions.
Who’s who in a WhatsApp chatbot
- Your business is the controller. You decide what your customers’ data is used for.
- The chatbot provider is the processor. It handles the data on your behalf and must sign a data processing agreement with you (DPA, Article 28 GDPR).
- Meta delivers the messages. That’s how WhatsApp works for every business, whichever provider you use.
- The AI provider is a sub-processor. The model drafting the replies receives the conversation text, so where it runs matters.
Seven questions for any provider
- Where are conversations stored? Ideally, on servers in the European Union.
- Where does the AI run, and does it train on my data? Many chatbots send every message to models hosted in the US.
- Is there a DPA and a public sub-processor list? With each one’s country and purpose.
- What’s encrypted? Messages, files and credentials, in backups too.
- How long is data kept? And is it deleted automatically?
- How do your customers exercise their rights? Access, a copy and erasure of their data.
- Where does data go if I automate? Connecting external tools can take data out of Europe without anyone noticing.
How MuseRelay handles it
| Question | MuseRelay |
|---|---|
| Conversations | On EU servers: the main one in Germany and a replica in Spain. |
| AI | Models run in European regions (Belgium, Ireland and Germany), with no global zones. Providers don’t train on your data. |
| Contract and sub-processors | Public data processing agreement and sub-processor list. |
| Encryption | Message text and files (photos, audio, documents) are stored encrypted with AES-256; so are credentials. Everything travels over HTTPS. |
| Retention | Files are deleted automatically after the period you set (90 days by default). |
| Rights | Your customers get the privacy notice in the conversation itself and can ask for a copy of their data or its erasure from the same chat. |
| Automations | Only to servers in Europe and on request. We explain it in n8n and Make with your AI chatbot. |
On top of that, your number connects with your own Meta credentials: the permissions are yours and you can revoke them at any time. More in BYOK on WhatsApp, Instagram and Messenger.
What no provider can change
WhatsApp messages go through Meta: it’s the one delivering them. That’s the same with any chatbot or CRM you use. What does depend on your provider is everything else: where data is stored, who else processes it and how long it’s kept.
If you handle sensitive data
Clinics, beauty salons or advisory firms may receive health data or other specially protected data (Article 9 GDPR). A few practical tips:
- Set the assistant to ask for only what’s needed to book the appointment or solve the query.
- Tell it in its instructions not to ask for diagnoses or medical history over chat.
- Let someone on your team step in when the conversation requires it: in MuseRelay you can take over at any time.
Quick checklist for your business
- Sign the DPA with your chatbot provider.
- Add WhatsApp and the chatbot to your record of processing activities.
- Update your privacy policy: channel, purpose and providers.
- Tell customers they’re talking to an AI assistant: the EU AI Act requires it. Saying so in the greeting is enough.
- Ask for permission before sending marketing messages on WhatsApp.
- Decide how long you keep conversations and files.
FAQ
Is it legal to use an AI chatbot on WhatsApp in the EU?
Yes, as long as you comply with the GDPR: a legal basis for processing, clear information for the customer, a contract with your provider and appropriate security measures. If a customer writes to you asking for an appointment or information, replying is part of providing the service.
Does my data leave Europe with MuseRelay?
Conversations are stored in the EU and the AI runs in European regions. The full list of providers, with countries, is in Sub-processors.
Can I delete a customer’s data if they ask?
Yes. Your customer can also ask for it directly in the conversation.
Do I need consent for the chatbot to reply?
To reply to someone who writes to you, no: it’s part of handling their request. To send them marketing messages, yes, and WhatsApp requires it too.
